Terms of use

Acceptance

You accept the following Terms on each and every occasion that you purchase items from us whether through our website or by phone or fax.

  1. Definitions
    1. "You" or “your” as the context determines means the individual or organisation who buys, or agrees to buy the goods from us.
    2. "Contract" means the contract between us and you for the sale and purchase of goods incorporating these terms.
    3. "Goods" means the articles that you agree to buy from us.
    4. "Us" or “our” or “we” as the context may determine means The Card Studio Limited, Unit 2, The Maidstone Golf Centre, Sutton Road, Langley, Maidstone, Kent ME17 4TX Registered in England Number 5075313 and whose Registered Address is 28 Boughton Lane, Loose, Maidstone ME15 9QN.
    5. “Website” means www.thecardstudio.info and associated web sites and links whether visible or obscured
    6. "Terms" or "Terms of use” means the terms and conditions of sale as set out in this document and any special terms and conditions agreed in writing by us.
    7. “Business Day " means any day (other than a Saturday or Sunday) or any public holiday in England, Wales, Scotland or Northern Ireland.
  2. Conditions
    1. Nothing in these terms shall affect your statutory rights.
    2. These terms shall apply to all contracts for the sale of goods by us to you and shall prevail over any other communication, whether verbal or in writing through the website or otherwise or documentation from us or from you.
    3. Any variation to these terms (including any special terms agreed between the parties) shall only be applicable where expressly agreed in writing by us.
  3. Ordering
    1. We may choose not to accept an order for any reason and we are not obliged to disclose such reason.
    2. All orders made for goods whether through the website, post, phone or fax shall be deemed to be an offer by you to purchase goods in accordance with and full acceptance of these terms and are subject to acceptance by us.
    3. In the unlikely event that the goods ordered by you are not available from stock, we will notify you and give you the option to either wait until the goods are available from stock, or cancel the order or part order and receive a full or partial refund within 30 days.
  4. Refunds
    1. Where a refund becomes applicable this will be made by us using the same method used by you in your original transaction to purchase goods from us. If there is a fee or charge made to us for carrying out the refund this cost will be deducted by us from the refund due to you and the net value paid to you.
  5. Our Rights
    1. We reserve the right to adjust the price and specification of any item on our website from time to time at our discretion without notice.
    2. Quotations issued to you by us may be withdrawn or varied at any time and unless otherwise specified shall be automatically withdrawn after 30 days. No binding contract arises in any event until your written order has been accepted by us and confirmed in writing by one of our authorised representatives.
    3. Any samples, illustrations or descriptive material including but not limited to particulars of shade and pattern and other information contained in our website, brochures, advertising material or elsewhere shall not form part of the contract and shall be treated as approximate and for guidance only unless specifically stated otherwise. We may at our discretion from time to time vary the design of the goods from that advertised without notice to you provided that any such variations do not constitute material alterations to the goods.
    4. Each order shall be a separate contract. A breach by us in respect of one order shall not entitle you to terminate any other order or orders.
    5. If an item you order is not in stock and where our suppliers increase the cost of items ordered by you then we reserve the right to change the price of the item ordered by you to a higher charge than shown on our website at the time you made the purchase.
    6. We will use reasonable efforts within our direct control to ensure that our website is available 24 hours per day, but this may not always be possible. We accept no liability in the event that our website becomes temporarily unavailable.
    7. We reserve the right to withdraw any goods from our website at any time.
    8. We are not liable to you for withdrawing any goods from the website or for refusing to process an order at any time or for any reason.
  6. Price and Payment
    1. The price of the goods is as specified on our website.  The price is quoted in GB pounds and is inclusive of VAT where applicable.  The price excludes delivery charges which include the cost of carriage and packing (see Delivery Times and Costs).
    2. Every effort is made to ensure that the prices shown on our website are accurate at the time you place your order. We reserve the right by giving notice to you at any time before delivery, to increase the price of the goods to reflect any increase in the cost to us which is due to any factor beyond our reasonable control, any change in delivery dates initiated by you, or changes in quantities or specifications for goods which are requested by you, or any delay caused by your instructions or your failure to give us accurate information or instructions.
    3. The total purchase price, including VAT (if any) and delivery charges, will be displayed in your shopping basket prior to confirming the order.
    4. After the order is received, we will confirm by email the details, description and price for the goods. This acknowledgement is not notification that we have accepted your order.
    5. Payment of the price plus VAT and packaging and delivery charges must be made in full before despatch of the goods.
    6. Minimum order value £10.00.
    7. If within 14 days of our acceptance of your order we discover that all of the goods in your order are unavailable, we may terminate the contract and refund full payment to you within 7 business days. In these circumstances we will inform you as soon as possible.
    8. If within 14 days of our acceptance of your order we discover that some but not all of the goods in your order are unavailable, we will not supply those unavailable goods. We will notify you as soon as possible and offer you the option of cancelling your whole order or amending your order to substitute alternative goods for the unavailable items. If you do not cancel the order within 14 days of receipt of such notification, we will deliver the available goods in accordance with Clause 7 below. We will refund you for the unavailable goods or cancelled order as appropriate.
    9. If within 14 days of our acceptance of your order we discover a pricing error in respect of any or all of the goods ordered by you, we will notify you as soon as possible detailing the mis-priced goods. We will offer you the option of placing a new order at the correct price for those mis-priced goods; or cancelling the whole of your order; or cancelling your order for the mis-priced goods and reconfirming you order for the correctly priced goods. If within 14 days of our notification to you, you have not responded selecting one of these options then we at our sole discretion may cancel the entire order where all of the goods you ordered are found to be mis-priced and refund you any sum you have paid for these goods OR if only some of the goods you ordered are found to be mis-priced our contract with you will continue and we will deliver the correctly priced goods but we will not be under any obligation to supply you with the mis-priced goods and will refund you for any sum you have paid for the mis-priced goods.
    10. For the avoidance of doubt these terms will continue to apply where goods are unavailable and you order alternative goods from us, or where goods have been mis-priced and you subsequently order such goods at the correct price whether the order is placed through our website or otherwise.
  7. Delivery
    1. We only accept orders for delivery within the UK through the website. We aim to process each order you make within 48 hours of receipt. Goods supplied within the U.K. will normally be delivered to you within 7 business days of our acceptance of your order.
      Orders from locations outside the UK may be accepted at our discretion by special arrangement and agreement but only by phone or fax and not through the website.
    2. Delivery of the goods will be made to your address specified by you on the order and you will make all arrangements necessary to take delivery of the goods whenever they are tendered for delivery.
    3. Delivery shall be deemed to be achieved on the date of the first attempted delivery.
    4. Where the goods are to be delivered in instalments, each delivery will constitute a separate contract and failure by us to deliver any one or more of the instalments in accordance with this contract or any claim by you in respect of any one or more instalments shall not entitle you to terminate the contract.
    5. You will accept any partial deliveries made by or on behalf of us.
    6. We reserve the right to refuse to accept orders for a third party address which differs from your address and in particular where the registered address of your payment card (where you are paying by card) is different from the delivery address.
    7. If delivery cannot be made to your address, we will inform you as soon as possible and try to make revised delivery arrangements. If after the second attempt or after additional delivery attempts allowed for by our carrier we are still unable to achieve delivery the goods will be returned to us. On receipt by us of the undelivered goods we will refund you less the value of any damaged items and any costs for return of undelivered items and an administration fee of £5.00. 
    8. Every reasonable effort will be made to deliver the goods as soon as possible after the order has been accepted.  Any dates specified by us for the delivery of goods are intended to be an estimate and time of delivery shall not be made of the essence.  However, we will not be liable for any loss or damage whether of a direct or consequential nature suffered by you through any delay in delivery howsoever caused.  In this case, we will inform you as soon as possible.
  8. Cancellation and Return
    1. You will inspect the goods immediately upon receipt and will notify us via email or telephone (see Contact Us) within 48 hours of delivery if the goods are damaged or do not comply with any of the contract.  If you fail to do so, you shall be deemed to have accepted the goods. . If the goods appear damaged you are entitled to refuse to accept the delivery and notify us accordingly. If you are unable to check the goods at the time of accepting delivery you must endorse the delivery note “UNCHECKED”. Failure to do so may affect any warranty claim that you may make thereafter.
    2. Where a claim of defect or damage is made, the goods shall be returned by you to us, along with written details of the defect or damage.  You will be entitled to a full refund (including delivery costs) plus any return delivery costs if the goods are in fact defective.
    3. You have the right to cancel the contract at any time up to the end of seven business days after the goods are received by you. 
    4. Goods must be returned by you at your expense and should be properly packaged to prevent damage and be adequately insured for the return journey.  You will receive a refund of all monies paid for the goods (excluding delivery charges) and excluding the costs of the return delivery to us within 30 days or cancellation.  If you fail to return the goods within 30 days following cancellation, we will be entitled to deduct or charge the full costs of recovering the goods from you. If some or all of the goods are received back by us damaged then the value of the items received in a damaged state will not be refunded to you.
  9. Warranty
    1. If the products we deliver to you are not as ordered, or are damaged, defective or of incorrect quantity, our liability shall be limited to replacing the damaged or defective products, or making good the shortfall in quantity or at our option crediting the price and delivery charges of those products to you.  We will not be liable to you for failure to deliver products ordered by you unless notified to us within 42 days of the date of order.  Our liability will be limited to delivering the products ordered or at our option, crediting the price and delivery charges of the non-delivered products to you.
    2. We will not be liable for any direct, indirect, special or consequential loss or damage including loss of profit or benefit of use or any other form of compensation (including but not limited to whether for loss of profit, goodwill, savings or contracts), costs, expenses whether caused by us or our suppliers or delivery agents or otherwise which arises out of or in connection with this contract. 
    3. Nothing in these terms shall be construed to limit our liability for death or personal injury caused by our negligence.
    4. This does not affect your statutory rights.
  10. General
    1. The headings in this contract are for convenience only and shall not affect their interpretation. The use of capitalisation in these terms is not material.
  11. Force Majeure
    1. We will not be liable for any delay or failure to perform any of our obligations if the delay or failure results from events or circumstances outside our reasonable control, including but not limited to acts of God, strikes, lockouts, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply and we will be entitled to a reasonable extension of our obligations.
  12. Data Protection
    1. We will take all reasonable precautions to keep the details of your order and payment secure but unless we are negligent, we will not be liable for unauthorised access to information supplied by you.
  13. Severance
    1. If any term or provision of these terms is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these terms and conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.
  14. Changes to Terms
    1. We are entitled to alter these terms at any time but this right shall not affect the existing terms accepted by you upon making a purchase.
  15. Governing Law and Jurisdiction
    1. These terms shall be governed by and construed in accordance with the laws of England and Wales and the parties hereby submit to the exclusive jurisdiction of the English courts.
